SofaScroll Terms of Use (End User License Agreement)

SofaScroll is a video-queue and co-watching app for couples and small groups, published by Ellefsen Marketing ("we", "us"). These Terms of Use, together with our Privacy Policy, are the agreement ("Terms" or "EULA") between you and us. By creating or joining a room, signing in, or otherwise using SofaScroll, you agree to these Terms. If you do not agree, do not use the app.

1. Zero tolerance for objectionable content and abusive users

There is zero tolerance for objectionable content or abusive behavior on SofaScroll. You agree not to share, post, link to, or transmit any content, and not to behave in any way, that is objectionable, including content or conduct that is:

• sexually explicit, pornographic, or that sexualizes minors in any way;
• hateful, harassing, bullying, threatening, or that demeans a person or group based on race, ethnicity, national origin, religion, disability, gender, age, sexual orientation, or gender identity;
• violent, that promotes self-harm, or that incites or threatens harm to others;
• illegal, that promotes illegal activity, or that infringes anyone's intellectual property or privacy rights; or
• spam, a scam, malware, or otherwise deceptive.

This applies to everything you contribute, including video links, titles, notes, comments, display names, and room names. Accounts that post objectionable content or abuse other users are removed.

2. Reporting and our 24-hour commitment

Every shared video and every comment can be reported from inside the app. When you report content, it is sent to our moderation team for review. We act on reports of objectionable content within 24 hours by removing the offending content and ejecting the user who provided it. We may take action with or without notice, at our sole discretion.

3. Blocking

You can block any other user from inside the app. Blocking immediately hides that person's videos and comments from your view, and notifies us so we can review their content. You can see and manage who you have blocked under Settings.

4. Your content and the license you grant

You are solely responsible for the content you add and for ensuring you have the right to share it. You retain ownership of what you contribute. You grant us a limited, non-exclusive, worldwide license to host, store, display, and transmit your contributions to the members of the rooms you share them to, solely to operate the app. You grant other members of your rooms the ability to view what you share within those rooms. We may remove any content at any time, for any reason, including content that violates these Terms.

5. Third-party content and services

SofaScroll lets you save and organize links to videos hosted by third-party platforms such as TikTok, Instagram, YouTube, X, Facebook, and Snapchat. Those services and their content belong to their respective owners and are governed by those owners' own terms. SofaScroll is an independent app and is not affiliated with, endorsed by, or sponsored by any of those platforms. You are responsible for complying with the terms of any platform whose links you share, and you must only share content you are permitted to share.

6. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use SofaScroll, and old enough to form a binding contract. If you are under the age of majority, you may use the app only with the involvement of a parent or guardian.

7. Accounts and security

SofaScroll signs you in anonymously by default and optionally lets you link a sign-in (Sign in with Apple on iOS, Google on Android) so your queue survives a reinstall. You are responsible for activity that occurs in your room. Keep your pairing codes and invite links private.

8. Acceptable use

You agree not to: misuse or interfere with the app or its infrastructure; attempt to access data that is not yours; reverse engineer the app except where that restriction is prohibited by law; use the app to violate any law or any third party's rights; or use the app to harass, abuse, or harm another person.

9. Termination

We may suspend or terminate your access to SofaScroll at any time, including for any violation of these Terms. You can stop using the app and delete your data at any time. See Delete your account.

10. Disclaimers

SofaScroll is provided "as is" and "as available", without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the app will be uninterrupted, error free, or that any third-party content will remain available.

11. Limitation of liability

To the fullest extent permitted by law, Ellefsen Marketing will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the app. Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the date above and may ask you to accept the new Terms in the app before you continue. Your continued use after an update means you accept the revised Terms.
